We represented in his divorce an actor who starred in and produced a popular national television show. The couple had lived in Texas for years before moving to another state where alimony was typically ordered. Though the couple had lived out-of-state for more than 2 years, his wife filed for divorce in Texas. Once she decided that it was to her advantage to re-file in their new home state, she sought to re-file there. We successfully opposed dismissal of the Texas suit by showing that their leaving Texas was temporary, that they always intended to return, and that they considered themselves Texans even while living out-of-state. In the words of our client, and quoted by the court in its decision, “It’s not where you lay your head at night, it’s where you lay your head in your head.”
